Agents justified in fatal shooting of MN sex offender, prosecutor says

10-21-2016 Minnesota:

ALEXANDRIA, Minn. — A man who was shot and killed by officers at an Alexandria home in August was within 4 feet of the officers while armed with a knife, a release from Douglas County Attorney Chad Larson said Friday, Oct. 21.

Larson concluded the shooting of Adam Jo Klimek, 31, of Carlos, by agents from the Minnesota Bureau of Criminal Apprehension was a justifiable use of force done in self-defense.

“I have chosen not to present this case to a grand jury because the facts do not warrant it.” Larson said in his release.

“The two BCA agents involved, agents Elizabeth Eilers and Dustin Vanderhagen, were victims of a crime that day. … In my opinion, they should be commended for their service to the public in the face of lethal opposition.”

8-31-2016 Minnesota:

New details are emerging about the investigation into a South St. Paul teacher and his husband who were found dead in Washington State.

Graphic court documents detail that at least three teenagers reported they had been sexually assaulted by 40-year-old Aric Babbitt and 36-year-old Matthew Deyo.

Babbitt and Deyo were found dead on Lopez Island north of Seattle last Thursday. Both died from gunshot wounds, and their deaths were ruled murder-suicide; San Juan County Sheriff Ron Krebs said a suicide note was found that said the couple had visited the island years ago and loved it.

According to search warrants, a 16-year-old boy and his parents reported a sexual assault to police on Aug. 14.

The teenager said Babbitt had been his teacher and mentor and was in charge of him while volunteering at Lincoln Center Elementary.

Oregon prison killing suspect killed Minnesota inmate

8-21-2013 Oregon:

The man suspected of killing his cellmate at the Oregon State Penitentiary murdered a fellow inmate in a Minnesota prison in 1997.

Craig Dennis Bjork, 53, was identified as the inmate suspected of strangling 45-year-old Joseph Akins, who was found dead in his cell Saturday, according to Marion County Deputy District Attorney Paige Clarkson.

Bjork entered the Oregon Department of Corrections of Jan. 16, 2013 on an interstate compact from Minnesota where he was serving three consecutive life sentences for the 1982 murders of his 1- and 3-year-old boys, his girlfriend and another woman, according to a 1997 article in the Minneapolis Star Tribune

In 1997, Bjork beat fellow inmate Edwin Curry, 41, to death with a pipe in a basement kitchen area in the Minnesota Correctional Facility at Stillwater. He told guards he planned to kill several more inmates if he had time, the Star Tribune reported.

Bjork and Akins shared a cell together in the C-Block of the Oregon State Penitentiary. On Sunday, the Oregon State Medical Examiner determined Akins died of “inflicted trauma.”

Bjork was held in segregation as the investigation continued.

Once the investigation is complete, the DA’s office will determine the criminal charges against Bjork and prepare the case for the grand jury.
