A deadly shooting is under investigation in Cullman County.

It happened Sunday at about 7:00 p.m. Sheriff deputies say a man shot at a person through the window of the Berlin Plaza Quick Stop off Highway 278. No one was hurt, and the suspect drove off on a motorcycle.

While investigators were on the scene, they received another call about a shooting at a house down the street. When they arrived, they found Raymond Earl Brooks, 59, dead from a gunshot wound.

Jay Maynor, 41, was later taken into custody for questioning. Charges are expected to be filed Monday.



Sheriff Mike Rainey cannot confirm whether a 2002 sex abuse case has any connection to the shooting, but Brooks was a registered sex offender. Family members tell ABC 33/40 they believe there is a connection to the case. ..Source.. by Erica Huddleston



Berlin man dead following two shootings Sunday evening

BERLIN – Shortly after 7 p.m. deputies with the Cullman County Sheriff’s Office responded to both the Berlin Plaza Quick Stop and a residence along U.S. Hwy 278 East after receiving multiple shooting calls in the area.

Cullman County Sheriff Mike Rainey said deputies responded to the call to the Berlin Plaza Quick Stop before receiving the second shooting call.

“We responded to the Berlin Plaza Quick Stop where witnesses told deputies a male subject pulled up on a motorcycle before shooting at the store’s window,” Sheriff Mike Rainey said. “After the would-be victim was able to elude the shooter, the suspect then drove off and went to the residence of Raymond Earl Brooks.”

Details of exactly what happened next are not fully known, with the exception that Brooks, 59, was shot and killed in his home, located at 4932 U.S. Hwy 278 East.

“At this time we are still investigating both crime scenes, the one at the store and at Mr. Brooks’ residence,” Rainey said. “We just ask that the public stay patient as our investigators work to piece together the events which took place Sunday night.”

Rainey said a suspect, 41-year-old Jay Maynor of Cullman, was taken into custody following the shootings by Alabama State Trooper Anthony Peebles.

“Trooper Peebles was responding to the scene when Maynor pulled out onto the roadway from the Brooks’ residence, directly in front of the Trooper,” Rainey said. “I want to extend a personal thank you to Trooper Anthony Peebles for his quick response and apprehension of the suspect.”

At this time Maynor is being held at the Cullman County Detention Center for questioning regarding both the fatal and non-fatal shootings.
EDITORS NOTE: Brooks was convicted of Sexual Abuse – 1st degree on August 26, 2002. The incident involved an 8-year-old female. Since that time he has had to register as a sex offender.
When asked if this had any role in the night’s shooting, Rainey said “we are investigating all aspects of this case and cannot comment on motive at this point. Our thoughts and prayers are with the victim’s family.”

Maynor is currently being held at the CCDC for questioning regarding the shootings which took place Sunday evening. Charges are expected to be filed as early as Monday.

One killed in Cullman County shooting spree

BIRMINGHAM, AL (WBRC) - Cullman County deputies say a man went on a shooting spree in the Berlin community Sunday night. One man was killed.

Sheriff Mike Rainey says it started at a store on Highway 278. According to Rainey, the suspect shot at a potential victim in the parking lot of the store, but no one was hit.

The suspect, identified by the sheriff's office as Jay Maynor, then rode a motorcycle to another man's house in the Town of Holly Pond. At the scene, he asked a woman to get her son to come outside, at which point, the sheriff says that Maynor shot and killed her son.

Maynor was arrested on Highway 278, not far from where the fatal shooting took place. He is expected to be formally charged this morning. ..Source.. by WBRC Staff



Man charged with killing sex offender in Cullman Co.

A man suspected of killing a registered sex offender in the Berlin community has been charged with murder.

The Cullman County Sheriff's Office identified the victim as Raymond Earl Brooks, 59. The suspect in the case, 41-year-old Jay Maynor of Cullman, is charged with Brooks' murder.

Court documents indicate Maynor is a relative of the child Brooks pleaded guilty to sexually abusing in 2002. Brooks was convicted in an incident involving an 8-year-old girl.

Sheriff Mike Rainey said the first shooting happened at the Berlin Plaza Quick Stop on Highway 278 shortly after 7 p.m. Witnesses told deputies a man drove up on a motorcycle and fired shots at the store's window, Rainey said.

"After the would-be victim was able to elude the shooter, the suspect then drove off and went to the residence of Raymond Earl Brooks," Sheriff Rainey said.

The sheriff's office said on Monday they don't know the full extent of the details, but confirmed Brooks was shot at his home in the 4300 block of U.S. 278 East.

A state trooper who responded to the scene saw Maynor pull out onto the road from Brooks' home and took him into custody, according to the Sheriff's Office.

"At this time we are still investigating both crime scenes, the one at the store and at Mr. Brooks' residence," Sheriff Rainey said in a release. "We just ask that the public stay patient as our investigators work to piece together the events which took place Sunday night."

Brooks was convicted of first degree sex abuse of an 8-year-old girl in August 2002 and has been a registered sex offender since then.

Sheriff Rainey would not comment on whether or not Brooks' sex abuse conviction had a role in the shooting.

"We are investigating all aspects of this case and cannot comment on a motive at this point. Our thoughts and prayers are with the victim's family," the sheriff said.

Maynor was booked into the Cullman County Detention Center for one count of murder, one count of attempted murder and one count of shooting into an occupied dwelling. ..Source.. by Melynda Sides



Jay Maynor charged with murder of sex offender Raymond Earl Brooks who molested his daughter

A MAN has been charged with killing the man who molested his daughter more than a decade ago.

Jay Maynor, 41, was charged by the Cullman County Sheriff’s Office with shooting dead Raymond Earl Brooks, 59, a registered sex offender who was living with his parents in Cullman, Alabama, reported the Cullman Times.

Brooks was convicted of sexual abuse in the first degree in 2002 in a case involving Maynor’s eight-year-old daughter.
Brooks was allegedly shot several times by Maynor, who was on a motorcycle.

Maynor is accused of opening fire outside Berlin Plaza Quick Stop before the alleged killing when he saw a man who has been dating his stepdaughter, said Chief Deputy Max Bartlett. The intended victim got away by running into the store and hiding.

“We responded to the Berlin Plaza Quick Stop where witnesses told deputies a male subject pulled up on a motorcycle before shooting the store’s window. After the would be victim was able to elude the shooter, the suspect then drove off and went to the residence of Raymond Earl Brooks,” sheriff Mike Rainey said in a press release.

Investigators are investigating if there is any connection between Brooks and the man who escaped.

The father and Brooks “obviously didn’t have a whole lot of good blood between them,” but it was unknown whether the shooting was directly linked to the sex abuse case, Bartlett added.

“It is odd. He apparently had a lot of stressors going on in his life,” Bartlett said.

Documents show Maynor was a witness against Brooks in a sexual abuse case involving his daughter in 2001. Police said the girl was eight at the time, but court records state she was seven.
Brooks pleaded guilty to sexual abuse in 2002 and initially was sentenced to five years in prison but later received probation, records show. He finished paying $2,946 in restitution and costs in 2009.

Maynor also was charged with attempted murder and shooting into an occupied building. He is being held in custody. ..Source.. by news.com.au



Attorney says man accused of killing sex offender shouldn't face murder charge

BIRMINGHAM, AL (WBRC) - Tommy Drake, the attorney for Jay Maynor,
says his client should not be charged with murder in the alleged killing of Raymond Brooks. Brooks is the man accused of molesting Maynor's relative.

"It goes beyond simply that this happened 12 years ago," Tommy Drake said. "It shouldn't be murder, it should be called 'heat of passion murder,' that would be manslaughter. That would be a lesser included murder."

Drake says Maynor and his family suffered great anguish and anxiety over the years since their relative was allegedly molested by Brooks.

"Over the years they've questioned why such a thing could happen," Drake said.

Drake says it continued to weigh heavily on Maynor. Last Sunday, there was something that happened between Brooks and Maynor which led to the killing.

"There was a catalyst. There was a trigger that occurred on the date this occurred that has implicated my client that gave rise to the fact now for which he's charged. Meaning there was an event that took place on that day that pushed my client over the edge," Drake said.

Drake couldn't elaborate on what it was that triggered Maynor that day, but he says the facts will be brought out to the jury.

"Unfortunately, we believe that once we try this case we'll be able to prove there was a reason for this," Drake says.

Maynor is also charged with attempted murder for allegedly shooting at his step-daughter's boyfriend at a gas station. Drake says those are allegations at this point and he's still gathering the facts.

Maynor has a cash bond set at $141,000 and Drake says that's too much for Maynor. Drake is working to change it to a property bond and get it reduced so Maynor can get out of jail. ..Source.. by Sherea Harris



Father of slain sex offender: 'My son didn't deserve it'

BIRMINGHAM, AL (WBRC) - The father of a convicted sex offender who was killed in a shooting in Cullman County says his son did not deserve to be shot.

"The next thing I heard were three shots and my wife hollering, 'No, no, no'," said Ralph Brooks, recalling the events of Sunday night.

Ralph Brooks says at that moment he went out to his front porch. He then found his son, 59-year-old Raymond Brooks, dead on the ground next to the house.

Cullman County Sheriff's detectives say 41-year-old Jay Maynor is the one who went to the home and shot and killed Raymond Brooks.

"No, my son didn't deserve it," Ralph Brooks said.

Ralph Brooks says he is not sure why Maynor targeted his son, but he suspects it may be connected to his son's child molestation conviction. In 2002, Raymond Brooks pleaded guilty to molesting a child and had to register as a sex offender. The child he was accused of molesting is related to both Raymond Brooks and Jay Maynor.

"Raymond went to prison and served 27 months with no problems," Ralph Brooks said.

Ralph Brooks says his son turned his life around since the conviction. He says he lived a godly life and was active in his church. Brooks says because the conviction happened so long ago, he's not sure if this was some form of revenge.

"It would be unbelievable to hold animosity in your heart for 12 years," said Brooks.

Cullman County Chief Deputy Max Bartlett says detectives have not determined an exact motive. He says all the facts have not yet been presented to the District Attorney.

"It's pretty bizarre he'd wait that long if that in fact it is what it was, in retaliation for the sexual assault. We don't know that for 100 percent sure. It's tragic for them, too. Regardless of what their son did, they still love their son I'm sure," said Bartlett.

"The judicial system has a job to do. I'm leaving it up to the courts and my Master. That's all I got to say," said Ralph Brooks.

Chief Deputy Bartlett says Maynor is also charged with attempted murder. Maynor is accused of shooting at his step-daughter's boyfriend at a gas station, moments before going to Brooks' home and allegedly shooting and killing him. ..Source.. by Sherea Harris
